1. Introduction

These Terms and Conditions apply to this website, the online booking platform, and to the transactions related to the products and services provided by Mike Konnos Luxury Boat Charter Ltd (hereinafter referred to as “the Company”, “we”, “us”, or “our”). This includes the hourly rental, half-day, full-day, and multi-day chartering of luxury yachts and boats, as well as the use of our online services. By booking a charter, you may be bound by additional specific charter agreements. If any provisions of those additional contracts conflict with these Terms, the specific charter agreement will prevail.

2. Website Use and User Accounts

2.1 Eligibility: By using this website and booking our services, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding contract.

2.2 Account Creation: To access certain features or book a yacht, you may be required to register an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

2.3 Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. 2.4 Prohibited Conduct: You agree to use our website only for its intended purposes. Engaging in any activity that causes damage to the website, interferes with its performance, involves malicious software, attempts unauthorized access, or utilizes automated data collection (scraping) is strictly prohibited.

3. Online Bookings and Pricing

3.1 Booking Process: The display of yachts and services on our website constitutes an invitation to treat, not a legally binding offer. A contract is only formed when you complete the online booking process, we successfully process your payment, and we send you a formal booking confirmation via email. 3.2 Availability and Pricing: All yachts and charters are subject to availability. We reserve the right to modify prices at any time without prior notice. 3.3 Pricing Errors: While we strive for accuracy, errors in pricing or vessel availability may occur on the website. In the event of a manifest error, we reserve the right to cancel any orders placed for a service listed at the incorrect price and will refund any payments made.

4. Payment Processing and Security

4.1 Online Payments (Stripe): All online payments for bookings made through our website are securely processed by our third-party payment gateway provider, Stripe.

4.2 Payment Terms: By submitting your payment information, you authorize Stripe to charge the applicable fees to your selected payment method. You also agree to be bound by Stripe’s own Terms of Service and Privacy Policy, which govern the processing of your financial data.

4.3 Data Security: Mike Konnos Luxury Boat Charter Ltd does not directly collect, process, or store your full credit card or financial details on our own servers. All such sensitive data is handled securely by Stripe in compliance with Payment Card Industry Data Security Standards (PCI-DSS).

4.4 Additional Costs: Unless otherwise specified, the charter fee does not include gratuities, excessive fuel consumption beyond the agreed itinerary, special requested provisions, or mooring fees at third-party marinas. These may be billed separately or deducted from your security deposit.

5. Cancellations and Refund Policy

Due to the nature of the luxury yacht charter industry, cancellations severely impact our scheduling and operations. Therefore, the following policies apply:

5.1 Cancellation by the Client:

  • More than 30 days prior to departure: 100% refund of the amount paid, minus a standard administrative/processing fee.
  • Between 14 and 30 days prior to departure: 50% refund of the total charter fee.
  • Less than 14 days prior to departure: No refund will be issued. The full charter fee is retained.
  • No-Shows: Failure to arrive on the day of the charter will result in a 100% forfeiture of all payments made.

5.2 Cancellation by the Company (Weather & Mechanical):

  • Weather Conditions: Charters will proceed rain or shine unless the weather conditions are deemed unsafe (e.g., severe storms, dangerous sea states, high winds). Only the Captain has the authority to cancel a trip due to weather. If the Captain cancels the trip prior to departure due to unsafe weather, the Client will be offered an alternative date. If rescheduling is not possible, a full refund will be issued.
  • Mechanical Failure: In the rare event of a mechanical failure prior to departure that prevents the charter from taking place, we will attempt to provide a substitute vessel of similar or better quality. If this is not possible, a full refund will be provided. If a mechanical failure heavily interrupts an ongoing charter, a pro-rated refund will be calculated based on the lost time.

6. Exemption from Statutory Right of Withdrawal

IMPORTANT: Pursuant to applicable consumer protection laws in Cyprus and the EU Directive 2011/83/EU, the statutory 14-day right of withdrawal does not apply to contracts for the provision of passenger transport services, accommodation, or services related to leisure activities if the contract provides for a specific date or period of performance. Therefore, all bookings are bound strictly by the Cancellation Policy detailed in Section 5.

7. Yacht Rules, Safety, and Real-Life Scenarios

To ensure the safety of all passengers and the preservation of our vessels, the following rules apply:

7.1 Captain’s Ultimate Authority: The Captain is in absolute command of the vessel. The Captain’s decisions regarding navigation, safety, weather routing, and passenger behavior are final.

7.2 Real-Life Yacht Problems:

  • Seasickness: We do not offer refunds or time extensions if members of the charter party suffer from seasickness. The Captain may, at their discretion, alter the route to find calmer waters, but the charter time remains billable.
  • Itinerary Changes: The advertised or requested itinerary is always subject to change based on wind, weather, and sea conditions to ensure passenger safety and comfort.

7.3 Delays:

  • Client Delay: If the Client arrives late, the charter will still end at the originally scheduled time. No refunds or time extensions will be granted for time lost due to client tardiness.
  • Company Delay: If departure is delayed by the Company (e.g., for extra cleaning or minor maintenance), the lost time will be added to the end of the charter, or a pro-rated refund for the lost time will be offered.

7.4 Prohibited Items and Behavior: * Zero Tolerance for Illegal Substances: The use or possession of illegal drugs is strictly prohibited. If discovered, the charter will be terminated immediately, the authorities will be notified, and no refund will be given.

  • Red Wine & Staining Items: Red wine, heavily staining foods, and tanning oils that stain teak decking or upholstery are prohibited on board unless explicitly approved.
  • Footwear: High heels and hard-soled shoes are not permitted. Guests will be asked to remain barefoot or wear provided yacht slippers while on board.

7.5 Termination for Cause: The Captain has the right to terminate the charter immediately, without refund, if passengers are heavily intoxicated, abusive, refuse to follow safety instructions, or engage in behavior that endangers the vessel or its occupants.

8. Limitation of Liability

8.1 Maritime & Inherent Risks: The Client acknowledges that boating, swimming, and the use of water toys (e.g., snorkeling gear, paddleboards, jet skis) involve inherent risks of injury or death. Participation in these activities is entirely at the Client’s and their guests’ own risk. 8.2 Personal Property: We are not responsible for the loss, damage, or water damage of personal items brought on board (e.g., smartphones, cameras, jewelry, clothing). 8.3 Website Liability: The website is provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, error-free, or completely secure from viruses or cyber-attacks. We will not be liable for any damages resulting from the use or inability to use our online platform. 8.4 Maximum Liability: To the maximum extent permitted by Cyprus law, Mike Konnos Luxury Boat Charter Ltd’s liability for any damages arising out of the charter or the use of our services will be limited to the total price paid by the Client for the specific transaction in dispute.

9. Intellectual Property

We own and control all of the copyright and other intellectual property rights in this website. You may not use, copy, reproduce, distribute, or commercialize any resources (including text, images, logos, and website design) on this website without our prior written permission.

10. Third-Party Links

Our website may include hyperlinks to external websites (e.g., local tourism boards, marinas). We do not monitor or review the content of other parties’ websites and are not responsible for their privacy practices or content. You access third-party websites at your own risk.

11. Privacy and Electronic Communications

11.1 Privacy: Your personal data is treated with the utmost confidentiality. Please refer to our Privacy Statement and Cookie Policy for detailed information on how we collect, store, and process your data during the browsing and booking process. 11.2 Electronic Communications: By using our website or communicating with us electronically, you consent to receive communications from us electronically (via email or website notices) and agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.

12. Force Majeure

Except for payment obligations, neither party will be liable for any failure or delay in performing an obligation under these Terms that is due to any of the following causes: acts of God, severe weather, pandemic, accident, riots, war, terrorist act, epidemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, or changes in laws or regulations.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mike Konnos Luxury Boat Charter Ltd, its officers, directors, employees, and agents (including Captains and crew) from and against any and all claims, liabilities, damages, losses, and expenses relating to your violation of these Terms, the specific charter agreement, your use of the website, or applicable maritime laws.

14. Updating of these Terms and Conditions

We may update these Terms and Conditions from time to time. Your continued use of this website and our booking services following the posting of changes will be considered notice of your acceptance to abide by the updated terms.

15. Choice of Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Cyprus. Any disputes relating to these Terms and Conditions, the use of the website, or any charter undertaken with the Company, shall be subject to the exclusive jurisdiction of the courts of Cyprus.
